Expanify Inc. ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy sets forth our data protection policies and describes our practices and guidelines for collecting, using, and disclosing your information when you install and or use the HeartGuard mobile device software app ("App," "our App"). It also informs you about your privacy rights and available legal protections.

We use Your Personal Data to improve and provide the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy applies to all users who access and use this app ("Individuals").

Please read the following Privacy Policy carefully before you officially use our services. If you continue to use it, it means that you have read, understood and agreed to be bound by these terms. Otherwise, you should stop using our services immediately.

 

I. Information We Process

 

When you use our products and services, we collect personal information in accordance with the specified purposes and methods outlined below. This includes details you voluntarily provide or authorize us to collect during registration and usage, as well as information generated through your interaction with the service.

 

i. Information that you submit

During your use of our services, you may voluntarily submit certain personal information, which we will use reasonably to ensure the normal operation of the services we provide to you. This includes:

Account information. General information you submit when creating an account. This includes: gender; age or date of birth; height; weight, etc.

Contact information. In order to contact you when necessary, we may collect your name, email address, password, and other information you choose to share when logging in via a third-party service when you log in via email or name and actively contact us by email.

Health and other related information. This app collects or estimates your health data for your reference. This includes: physiological information such as heart rate, blood pressure, blood oxygen, body stress level, energy level; comparative information such as health scores; physical characteristics such as height, weight, BMI; other information such as heart rate variability, etc.

All of this measurement data is actively entered or monitored by you while using our app. If you choose to connect Apple Health to our app, we will also import your health data. You can refuse to have your data measured at any time, and you can also delete the data you have saved at any time.

During the measurement process, we use your device's camera as a sensor to estimate your heart rate data. During the measurement, the image data transmitted by the camera is processed on your local device and automatically deleted after the measurement is complete. We do not store or use any of your photo album data.

Other data you may submit to us. We may collect data you submit when you participate in any interactive features, surveys, promotions, or request customer support through our app, communicate with us, or otherwise contact us.

Personal information of others. If you submit personal information about others, this means that you expressly agree that you have sufficient rights to submit such data on their behalf and will strictly collect and use their personal information as described in this Privacy Policy.

 

ii. Usage Information

When you access or use our services, we collect certain usage data. This includes information related to your interactions with our services, such as viewing content, installing apps or software, creating or logging into an account, or opening and engaging with an app on your device.

We also gather data about the devices and computers you use to access our services, including:

  •  Browser type and language;
  •  Operating system;
  •  Mobile device information (including device and app identifiers);
  •  Referring web page;
  •  Pages visited;
  •  Location (depending on permissions you’ve granted);

iii. Payment Information

All payments and deductions are processed through iTunes. In addition, our e-commerce providers may process your personal data and ensure its security when you use in-app purchases and online subscriptions, according to their needs. We cannot directly access your debit or credit card, nor can we deduct funds directly from your debit or credit card in any way.

 

iv. Information from Third-Party Services

We may obtain information through third-party partners, which is primarily used to analyze the performance, functionality, and error correction of the app. Additionally, we may obtain information through other third-party marketing partners and publicly available sources for other purposes described in this Privacy Policy. If you log in to this app through social media and identity verification services, we may access the information provided by these third-party social media or identity verification services. You should review the privacy settings of all these third-party services to understand and modify the information provided to us through these services.

 

v. Location Information

When you use our service, we collect and process non-precise location data, such as your time zone. This information is necessary to provide insights into your habits, health, and circadian rhythm—for example, by analyzing the consistency of your activity patterns throughout the day.

Certain features of this service may require precise location data, including GPS signals, device sensors, Wi-Fi access points, and cell tower IDs. We only collect such data if you grant us permission to access your location. You can revoke this access at any time through your mobile device settings. Additionally, we may estimate your approximate location using your IP address.

During your use of our app, your personal information will be stored on our secure cloud servers and protected by the security measures provided by the server provider. We will retain information only for the period necessary to provide services to you and other users, subject to any legal obligations that may require further extension of the retention period for such information.

 

We will retain the information necessary for you to log in to your account (such as your device ID, Apple ID, email address, password, etc.), as we need this information to manage your account. Additionally, we will retain certain personal information generated during your use of the service, including your heart rate, pulse, health score, cardiac stress, blood pressure, and exercise or activity data. This personal information is primarily used to provide you with personalized statistics, other service features, and commercial analysis. Furthermore, we may retain information related to you and your use of the service for commercial operations, to protect our legitimate commercial interests, to comply with legal requirements, or to prevent harm, as necessary. After you delete your account, we generally delete your personal information within 30 business days, but it may take up to 90 days for your personal information to be completely removed from our systems. We may also retain deleted data to comply with legal obligations, prevent fraud, collect fees, assist in investigations, and for other legally permitted actions. All information we retain will be processed in accordance with the terms of this Privacy Policy. If your personal information is no longer used for service purposes, it may be anonymized and aggregated with other non-personal data for our commercial analysis and statistical purposes.

Ensuring the safeguarding of your personal data is of utmost priority to us. Access/Export Your Personal Data

You have the right to access your personal data. You can log in to your device, find your personal data in the app, and export the data you have selected through the app settings.

 

Delete Your Personal Data

You have the right to delete your personal data within the scope required by applicable laws. You may also stop using our app at any time and request that we cease collecting and using your personal data. When you request the deletion of your personal data, you should send an email to contact@expanify.com, and we will respond and process your request within a maximum of 14 business days. However, you should understand and agree that in certain circumstances, we may be required by law to retain certain data for up to 90 days. In such cases, we will comply with your request after fulfilling the legal requirements.

 

Editing Your Personal Data

You can edit most of your personal data within the app. If you need to modify other data but cannot find the corresponding function, please send an email to contact@expanify.com, and we will assist you in processing your request within a maximum of 14 business days.

 

Restricting or Prohibiting the Use of Your Personal Information

You may request that we cease using all or part of your personal data, or prevent us from tracking certain personal data by selecting “Do Not Track” when launching the app. You have the right to object to the use of your information for direct marketing purposes. You may control our marketing communications about products via the “Update Preferences” and “Unsubscribe” links in the email. In addition to the various control measures we provide, in certain circumstances, you may request that we restrict the processing of your data. Please note that you may delete your account at any time.

Our services operate globally and we provide our apps to users worldwide. Data and materials collected through our services will be stored on servers operated by us and/or our affiliates. These servers and processes may involve cross-border data transfers to the regions where the information is collected or processed.

We take measures to ensure that recipients of personal data implement appropriate safeguards to comply with applicable data protection laws. By using the app, you acknowledge and agree that your personal data may be transferred to third countries, specific regions or departments within such countries, or international organizations.

Our services are not intended for children, and all users must be at least 13 years of age to use this service. If we discover that we have collected personal information from any child under the age of 13 without verified parental consent, we will promptly delete such information. We reserve the right to immediately terminate the account and permanently delete all related information (including health or sensitive information) from our servers.

When using our services in EU countries, you must meet the minimum age requirements set by local laws. In the European Economic Area or the United Kingdom, you must be at least 16 years old to explicitly consent to data processing and use our services. If you do not meet the required age, you may still use our services with the consent of your parents or guardians. If we inadvertently collect personal information from minor users, we will take reasonable measures to delete such information from our records as soon as possible.

If you discover that your minor child is using our services, we recommend that parents or guardians monitor their children's online activities and guide them not to disclose personal information to unauthorized websites. In order to ensure the normal operation of our services and for reasonable commercial purposes, we may cooperate with third-party partners that provide advertising and analysis services. Therefore, you may see certain third-party links in our app, which may redirect you to these third-party websites or apps. These third-party partners may use cookies and other similar technologies to collect information related to your interaction with the services and other websites and apps. You should review the privacy policies of the websites to which these links direct you. We are not responsible for the privacy policies or content of any third-party partners or service providers.

 

X.  DO-NOT-TRACK Features

 

Our services and apps include a “Do Not Track” (DNT) feature. You can enable/disable settings through this feature to indicate your privacy preferences—that is, whether you wish to be monitored or have your online activity data collected. Currently, we do not respond to DNT browser signals or other mechanisms that automatically convey your choice not to be tracked online. If a future online tracking standard is adopted that we must comply with, we will notify you of this practice through a revised version of this privacy statement.

 

XI.  Privacy Notice for California Residents

 

Pursuant to California Civil Code Section 1798.83 (also known as the "Shine The Light" law), we will allow our users who are California residents to request, once a year and free of charge, information about the categories of personal information (if any) that we disclose to third parties for their direct marketing purposes.

We do not sell or monetize your personal information by trading it with third parties. However, like many online businesses, we work with advertising partners to manage campaigns across platforms. In order to facilitate targeted advertising, we may share limited personal information in certain instances. Even though we don't make money by selling your personal information, you have the right to opt out of having your personal information shared with our analytics and advertising partners. If you are a California resident and under the age of 18, you have the right to request that we delete any unnecessary information we hold about you. To submit such a request, please reach out to us via email. We will not publicly display this data on the Service; however, please note that it may not be fully removed from all our systems, such as backups.

In order to provide you with better products and services, we may from time to time adjust or change this Privacy Policy in accordance with the introduction of new business features or as required by law or regulation. After we update this Privacy Policy, we will post an updated version and notify you by email or other means by which you can be contacted so that you can keep up to date with the latest version of this Privacy Policy, but you understand that this is not necessary.
